the founding fathers, are genuinely, some of the smartest legal and political scholars ever. They were brilliant. Through two opposite lenses, they founded a philosophy of federalism. Basically make the federal system as SLOW as possible and you can prevent mob rule and tyrants. And it worked. Federalism and English common law made America into the longest lasting government currently in power today. And it happened because of our founding fathers brilliance
When the constitution was being made, there were two schools of thought. Federalists and Anti-Federalists. One wanted a strong federal, the other wanted strong state power. When the constitution was made, Federalists were the majority opinions, so they made the constitution the way it was. However, to get the support of the Anti-Federalists, they had to agree to the bill of rights (the first ten amendments that include right to privacy, right to free speech, etc). The reason why the federalists wanted the Constitution without the bill of rights was because they wanted the courts to imply everything. Keep it all vague, and more power will be given to the people. The bill of rights changes all that, and now, every right that citizens have are written down word for word in the constitution.
The compromise was the ninth amendment. What’s the ninth amendment? Basically this is what it says: “Any rights that are not covered in the scope of this constitution or its amendments is AUTOMATICALLY assigned to the people.” Right to the environment, right to love whoever you want, even the right to transition medically SHOULD be covered by the ninth amendment. So what happened to it?
The ninth amendment has NEVER been enforced by the supreme court. It was only argued once, in the 1800s, to try to prevent slavery and was DENIED by the courts and has NEVER been argued over since.
We have an amendment SITTING right there in the constitution that destroys the “Originalist” and “Literalism” talking points and that still has no actual power because its never been cited to ever. WE SHOULD HAVE SO MANY MORE RIGHTS THAT HAVE BEEN TAKEN AWAY BECAUSE THEY DIDNT WANNA FREE THE SLAVES. FUCK THE SUPREME COURT, AND FUCK ANYONE WHO HAS GIVEN UP ON THE NINTH AMENDMENT.

this isnt some dick sucking of the founding fathers, They are the first people to create a system of governance for western nations. Regardless of ur opinions of them, they are objectively brilliant for creating a republic in a time when it wasnt just uncommon but completely unheard of. Divine Right was still mainstream at the time, and they broke rank with that line of thought, which was unheard of.
